Head Injuries are devastating injuries. They occur when an accident victim’s head accelerates or decelerates rapidly. Most often this happens in a car crash or some other situation where outside forces cause the victim’s head to strike an object. This sudden change in speed causes the bony structure of the head to change speed rapidly while the soft tissues of the brain take a fraction of a second longer to react. This creates shearing injuries in the brain resulting in traumatic brain injuries. Traumatic brain injuries can also occur even when the head does not strike and external object so long as the head is forced to accelerate or decelerate rapidly.
Some symptoms of head injuries are loss of consciousness, blacking out, headache, loss of memory, confusion and loss of mental function. Sometimes the loss of mental function can be subtle. For example, the victim may suffer a change in personality or an inability to remember telephone numbers.
In these situations, it is critical to work up the case to ensure that a proper settlement is achieved. The attorney should hire an expert in evaluating head injuries. The expert should give the victim a series of tests to evaluate both pre- and post-injury mental functioning. Obviously, it isn’t normally possible to give the tests pre-accident, in which case, the expert will talk to co-workers, family members and friends as well as obtaining school records, work records and other pre-injury evidence to establish a pre-injury baseline.
