Medical Negligence
A lawyer might say that medical negligence arises when a doctor fails to follow the standard of care and a patient is injured. What does that really mean? The medical profession has set up rules that doctors should follow to keep their patients safe. Those rules are the standard of care. When health care providers don’t follow those rules, they put their patients at risk. Sometimes, the doctor and patient gets lucky and nothing happens. Doctors that don’t follow the rules will eventually end up hurting patients.
To encourage bad doctors to act carefully and to force bad doctors to take responsibility for their sloppiness, Utah law requires doctors to take responsibility for the harm they cause when the act negligently. If the doctor does not volunteer to do this, the law allows the patient to make a claim against the doctor.
